Terms of Service

1. Acceptance of Terms

By accessing or using JIVUE ("the Service"), operated by JIVUE Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

JIVUE is an AI-powered virtual try-on platform that allows users to upload photos of themselves and garments to generate realistic images of how clothing might look on them. The Service uses artificial intelligence models to create these visualizations.

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activity under your account
  • Not create multiple accounts for abusive purposes

You must be at least 16 years of age to use the Service. By creating an account, you represent that you meet this age requirement.

4. Acceptable Use

You agree not to use the Service to:

  • Upload photos of other people without their explicit consent
  • Generate content that is sexually explicit, violent, harassing, defamatory, or otherwise objectionable
  • Attempt to reverse-engineer, decompile, or extract our AI models or proprietary systems
  • Use automated scripts, bots, or scrapers to access the Service
  • Resell, redistribute, or sublicense the Service or generated content for commercial use without our written permission
  • Circumvent rate limits, credit systems, or security measures
  • Upload content that infringes on the intellectual property rights of others
  • Violate any applicable law or regulation

We reserve the right to suspend or terminate accounts that violate these usage policies without prior notice.

5. Credits, Payments & Refunds

Free Tier

New accounts receive a limited number of complimentary credits (try-on and avatar generation credits) as stated at the time of registration. Free credits do not expire.

Paid Plans

  • One-Time Credit Pack ($7.99): 50 try-on credits + 1 avatar generation credit. These credits do not expire.
  • Pro Subscription ($12.99/month): 100 try-on credits + 2 avatar refresh credits per billing cycle. Unused subscription credits expire at the end of each billing period and do not roll over.

Billing

All payments are processed securely through Stripe. Subscription charges recur monthly on the same date you subscribed. You can cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

Refunds

Due to the computational cost of AI generation, credits that have been used are non-refundable. If a generation fails due to a system error, the credit will be automatically refunded to your account. For unused credit packs, you may request a refund within 14 days of purchase by contacting us at support@jivue.com.

6. AI-Generated Content & Disclaimers

AI outputs may vary. The Service uses artificial intelligence to generate virtual try-on images. Results are approximations and may not perfectly represent how a garment would look in real life. Factors such as lighting, body proportions, garment complexity, and photo quality affect output accuracy.

You acknowledge that:

  • Generated images are for visualization purposes only and should not be the sole basis for purchasing decisions
  • Colors, fit, and texture in generated images may differ from the actual garment
  • We do not guarantee any specific level of accuracy or realism
  • We are not responsible for purchasing decisions made based on generated images

7. Intellectual Property

Your Content

You retain ownership of the photos you upload. By uploading content, you grant us a limited, non-exclusive license to process your photos solely for the purpose of providing the Service (generating avatars and try-on images). We do not use your photos to train AI models.

Automatic photo deletion: Once your avatar has been successfully generated, the original front photo and selfie you uploaded are permanently deleted from our servers. We do not retain your raw personal photos beyond the generation process.

Generated Content

You own the AI-generated try-on images created from your photos and may use them for personal, non-commercial purposes. For commercial use, please contact us.

Our Property

The Service, including its design, code, AI models, and branding, is owned by JIVUE Inc. and protected by intellectual property laws. Nothing in these Terms grants you rights to our trademarks, logos, or proprietary technology.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

9. Account Termination

By you: You may delete your account at any time from the Settings page. Deleting your account permanently removes all your data, including photos, avatars, try-on results, and profile information. This action is irreversible.

By us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. We will attempt to provide notice before termination, except in cases of severe violations.

10. Limitation of Liability

To the maximum extent permitted by law, JIVUE Inc. and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Indemnification

You agree to indemnify and hold harmless JIVUE Inc. from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
